Terms of Use

The Terms of Use constitute a contract between you and pon (hereinafter also referred to as the service, application, or app). pon is an app and service offering by Adrian Kühlewind (hereinafter also referred to as the provider). We reserve the right to change these terms at any time and will inform you accordingly. Changes to the Terms of Use will only take effect 30 days after being announced. If you do not agree with a change, you can delete your account before the changes take effect. If you do not agree to these terms, you are unfortunately not authorized to access or use our services, content, and features. By registering for our service, using it, or continuing to use it after a change to the Terms of Use or Privacy Policy, we assume that you accept these terms and agree to be a contracting party to this legally binding agreement.

Usage

• The subject of this contract is the free or paid use of the pon app, which can be accessed via www.ponlist.de and its subpages, as a web application, or through desktop applications and corresponding mobile applications (hereinafter collectively referred to as "apps").
• With pon, we provide you with a service that allows you to plan and manage your shopping and collaborate with other users. We provide the technical infrastructure in the form of the application. However, the provider does not participate in the content-related networking or communication.
• The application is provided to the user free of charge. Paid features within the app may be added by the provider at any time and will be clearly marked. If pon offers paid features, you will be explicitly informed about the costs before making a purchase.
• To use certain features, registering a user account with your name, email address, and password may be required. You can also use our services without registration; however, the functionality may be limited in scope.
• There is no entitlement to the conclusion of a usage contract. We may reject your registration request at any time without providing reasons. In such cases, we will, of course, delete any data you have already provided.
• If you have the option to add images within the app, you are obligated to ensure that you hold the exclusive usage rights to these images and that making them publicly accessible or sharing other content does not violate any legal regulations, moral standards, or the rights of third parties.
• We are entitled to delete or replace any content you create at any time if there are concrete indications that it violates legal regulations, moral standards, or the rights of third parties.
• The application enables the exchange of messages between users, including via email. By using the service, you agree to receive such messages and commit to not sending any messages through the app that violate legal regulations. Within the app, you can disable certain notification functions yourself. We do not send unsolicited messages and will only contact you when important information regarding your use of the application arises.
• In general, the app also works without an internet connection; however, certain features may require an internet connection.
• We strive to ensure high availability and reliability of our services, but we cannot rule out the possibility of downtime or other technical issues. The user is responsible for regularly backing up their device's data.
• There is no entitlement to the use of our services. The provider may discontinue the application at any time without providing reasons or exclude a user from using the application.
• The provider may modify the application at any time without providing reasons, including changes to any paid features.

Termination

• The contract for the free use of the pon application is concluded for an indefinite period.
• If you have registered within the application, you can terminate the contract at any time by selecting "Delete Account" within your profile in the app. All your data will be deleted from our servers immediately.
• You can terminate the user agreement at any time via email, providing appropriate proof that the account to be deleted belongs to you.

Liability

• The provider assumes no liability for direct or indirect damages resulting from the use of pon or in connection with the provider's services, except where mandatory legal provisions apply. The provider is only liable for damages caused by willful intent or gross negligence. In cases of slight negligence, we are only liable if a fundamental contractual obligation (cardinal duty) is violated, which is essential for the provision of the service.
• In the event of violations of these Terms of Use or legal infringements resulting in claims from third parties, the user expressly releases the provider from all liability and shall be fully liable for any damages incurred by the provider.
